If in the process of divorce proceedings, separating parties are unable to come to a financial settlement amicably or through negotiation, Court proceedings may be issued after the Decree Nisi of divorce, with parties asking the Court to decide on a fair division of matrimonial property and finances.  This process is known as Ancillary Relief Proceedings. 

Each party will file an Affidavit setting out their financial position and lodge their financial discovery.  If settlement is not agreed by negotiation, the Court will hear the matter and make a determination as to the how the family finances should be dealt with.
